ClubTyra Terms and Conditions

1. General Overview

ClubTyra, operated by Tyra Motorworks Limited (”Tyra Motorworks”, “Tyra Mobile”, and “TRX Motors”), is a loyalty platform designed to reward members (“ClubTyra members”) for their purchases. By joining ClubTyra, members earn points (“ClubTyra Points”) on eligible purchases, enjoy exclusive benefits, and contribute to charitable causes. Participation in ClubTyra is voluntary and free of charge, and by enrolling, members accept these Terms and Conditions, forming a binding agreement with Tyra Motorworks Limited.

2. Membership Requirements

2.1. Eligibility
ClubTyra is open to individuals aged 18 and over only; It is not available to entities, individuals aged below 18 and individuals or individuals from nation states sanctioned by the United Kingdom and/or by international law.

2.2. Participation
Membership is free and voluntary, allowing members to earn and redeem points on qualifying purchases.

3. Earning Points

3.1. Accumulation
ClubTyra members accumulate ClubTyra Points at a rate based on their ClubTyra membership Tier on eligible products via Tyra Motorworks, Tyra Mobile, and authorized retailers, partners, or promotional events.

3.2. Point Value
1,000 ClubTyra Points is equivalent to 0.50 GBP.

3.3. Credit Timing
For purchases at Tyra Motorworks and Tyra Mobile, Points will be credited to the ClubTyra Member’s account within 3 days after the purchase is completed. Purchases with partners are subject to different credit timings. Contact ClubTyra support to know more info about credit timing on partner purchases.

3.4. Refund and Point Reversal
Points earned on transactions that are refunded or canceled will be deducted from the member's account.

3.5. Modifications
Tyra Motorworks reserves the right to modify the rules, rates, and conditions for earning ClubTyra loyalty points. Changes will typically take effect with prior notice, depending on the nature and impact of the modification. However, immediate changes may be implemented if necessary to address security concerns, system integrity, or legal compliance. All changes will be communicated through official channels.

4. Usage of ClubTyra Points

4.1. Redemption Options
ClubTyra Points can be redeemed on purchases at Tyra Motorworks, Tyra Mobile, charitable donations, prepaid Visa cards, and gift cards (e.g., Tyra Motorworks, Starbucks, Nike, CarbonFund.org).

4.2. Restrictions
ClubTyra Points cannot be exchanged for cash or transferred to another member unless authorized by Tyra Motorworks.

4.3. Expiration
ClubTyra Points expire after 1 year from the date of issuance if not redeemed.

4.4. Charitable Donations
Donations made using ClubTyra Points are non-reversible and must comply with the chosen charity's policies.

5. ClubTyra Membership Tiers

5.1. ClubTyra Tier Structure
ClubTyra offers a range of membership tiers designed to cater to diverse member profiles. While most tiers are publicly accessible and transparent, the program also includes exclusive, invite-only tiers that are not disclosed to the general public. These exclusive tiers offer enhanced benefits and privileges, fully compliant with all applicable legal standards and regulations.

5.2. Membership Tiers

ClubTyra Bronze

ClubTyra Bronze is the starting tier for all members. Members of this tier earn 50 ClubTyra Points for every £2 spent. The minimum redeemable limit for this tier is 5,000 ClubTyra Points.

ClubTyra Silver

ClubTyra Silver is the second tier, superior to Bronze. Members of this tier earn 75 ClubTyra Points for every £2 spent. The minimum redeemable limit is 7,500 ClubTyra Points. Members must accumulate 50,000 points to upgrade to this tier.

ClubTyra Gold

ClubTyra Gold is the third tier, superior to Bronze and Silver. Members of this tier earn 100 ClubTyra Points for every £2 spent. The minimum redeemable limit is 10,000 ClubTyra Points. To maintain this tier, members must pay an annual fee of £25 or use 75,000 points to upgrade permanently.

ClubTyra Platinum

ClubTyra Platinum is the fourth tier, superior to Bronze, Silver, and Gold. It is the highest publicly accessible tier, with members earning 150 ClubTyra Points for every £2 spent. The minimum redeemable limit is 5,000 ClubTyra Points. To maintain this tier, members must pay an annual fee of £50 or use 100,000 points to upgrade permanently.

Exclusive Tiers

Certain exclusive, invite-only tiers exist within the ClubTyra program. These tiers are designed for members who meet specific criteria or have a personal connection to Tyra Motorworks. Members in these tiers enjoy unparalleled benefits and privileges, including higher point accumulation rates and reduced redeem limits. These tiers are not advertised to the public but are subject to the same legal compliance as other tiers.

5.3. Tier Changes and Benefits
Membership tier progression is based on accumulated points or meeting other specified criteria. Benefits and requirements are subject to modification at the discretion of Tyra Motorworks. Members will be notified of changes where applicable.

6. Account Management

6.1. Member Responsibilities
ClubTyra members are responsible for keeping their membership information up to date, including contact details and preferences.

6.2. Inactive Accounts
Accounts with no activity for 24 consecutive months may be deactivated, and any remaining points will be forfeited unless explicitly stated otherwise.

6.3. Liability
Tyra Motorworks will not be liable for any loss of ClubTyra Points or benefits due to outdated or incorrect account information.

6.4. Forgotten Passwords
Members should contact customer service for assistance in recovering forgotten passwords or handling account access issues.

7. Member Succession Policy

7.1. Points Transfer Upon Passing Away
In the unfortunate event of a ClubTyra Member's passing, the member's accumulated ClubTyra Points may be transferred to a designated beneficiary or family member. To initiate this process, the following steps must be taken:

Notification: The designated beneficiary or family member should contact Tyra Motorworks customer service at clause 20.1 to report the member's death.

Documentation: A valid death certificate and proof of identity for both the deceased member and the beneficiary must be provided to verify the request.

7.2. Grace Period for Redemption
ClubTyra Points will remain valid for a period of twelve months following the ClubTyra member's death. During this time, the beneficiary or family member may redeem the ClubTyra Points for eligible rewards, including charitable donations, prepaid Visa cards, and gift cards.

7.3. Points Expiration
Any unredeemed ClubTyra Points will expire after the twelve-month grace period. It is recommended that beneficiaries redeem points promptly to maximize their value.

7.4. Updating Membership Information
To ensure proper communication and benefits transfer, it is essential for beneficiaries to keep the membership information up to date. This includes contact details and any changes in status.

8. Fraud, Misuse and Limitations on HRIs
8.1. Prohibited Activities
Any attempt to earn or redeem ClubTyra Points through deceptive or dishonest means is strictly prohibited. This includes, but is not limited to:

- Creating multiple accounts for point accumulation.
- Providing false information during account application or redemption processes.
- Manipulating or tampering with transaction records.
- Using automated means to engage with ClubTyra.
- Claiming points for invalid purchases.

8.2. Consequences
Tyra Motorworks reserves the right to limit ClubTyra members account to take actions in response to fraudulent activity. This includes, but is not limited to:Immediate suspension or permanent termination of the ClubTyra Member account with or without any prior notice.

- Forfeiture of all or partial of earned ClubTyra Points.
- Reversal of any ClubTyra Points or other reward/benefits obtained through fraudulent means.
- Restrict access to the ClubTyra loyalty platform in the future.
- Suspend reward/gift card redemption services.

8.3. Legal Action
In cases of significant or repeated fraud, Tyra Motorworks reserves the right to pursue legal action to recover damages and report fraudulent activities to authorities.

8.4. Account Monitoring
Tyra Motorworks employs monitoring systems to detect suspicious activities within the ClubTyra platform. Unusual patterns of point accumulation or redemption will be investigated.

8.5. Reporting Fraud
Members who suspect or affected by fraudulent activity are highly encouraged to report such activities immediately to Tyra Motorworks via the contact details referred in Clause 20.1.

8.6. Limitations on High-Risk Individuals (HRIs)
Tyra Motorworks reserves the right to limit ClubTyra membership services for individuals classified as High-Risk Individuals (HRIs) with or without any prior notice. This includes, but is not limited to, Politically Exposed Persons (PEP), persons flagged under UK or International sanctions and anti-money laundering (AML) watchlists.

8.7. ClubTyra Member Account Limitations
Tyra Motorworks reserves the right to limit ClubTyra members account if there is a suspicion of fraud, abuse or violation of these terms, the member is classified as a High-Risk Individual based on one of the factors defined in Clause 8.6 or if legally required.

9. Program Changes

9.1. Rights to Modify
Tyra Motorworks reserves the right to modify, restrict, or discontinue the ClubTyra platform at any time with prior notice.

9.2. Notice of Termination
If the platform is terminated, members will be given 30 days' notice to redeem their ClubTyra Points before the program ends.

10. Data and Privacy

10.1. Data Usage
By enrolling in ClubTyra, members consent to the use of their personal data in accordance with Tyra Motorworks Privacy Policy for purposes related to administering ClubTyra.

10.2. Marketing Communications
ClubTyra members may opt-out of marketing communications without affecting their participation in the ClubTyra platform.

11. Limitation of Liability

11.1. Liability Exclusions
Tyra Motorworks will not be held liable for any losses, damages, or claims arising from the suspension, modification, or termination of the ClubTyra platform.

11.2. Technical Issues
Tyra Motorworks is not responsible for technical errors or issues that prevent members from accessing or managing their accounts.

11.3. Intellectual Property
All logos, trademarks, and materials related to ClubTyra are the property of Tyra Motorworks Limited and cannot be used without prior written consent.

12. Dispute Resolution

12.1. Arbitration
Any disputes arising from these Terms and Conditions will be resolved through arbitration in accordance with the laws of England and Wales.

13. Governing Law

13.1. Legal Framework
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles.

14. Force Majeure

14.1. Force Majeure Clause
Tyra Motorworks will not be held liable for any delay or failure to perform its obligations under these Terms and Conditions caused by circumstances beyond its reasonable control, including, but not limited to, acts of God, war, terrorism, strikes, power failures, or any other event outside of Tyra Motorworks control.

15. Communication and Notices

15.1. Communication
Tyra Motorworks may communicate with ClubTyra members via email, phone, or other means. Members are responsible for keeping their contact information up to date to receive communications.

15.2. Notices
Any notice required under these Terms and Conditions will be deemed to have been properly given when sent to the email address associated with a member’s account or when posted on Tyra Motorworks’ website.

16. No Warranty

16.1. Warranty Disclaimer
Tyra Motorworks makes no representations or warranties about the availability, accuracy, completeness, or fitness for any particular purpose of the ClubTyra Points program or any goods or services associated with the program. The services are provided on an “as-is” basis, and members use them at their own risk.

17. Severability

17.1. Severability Clause
If any provision of these Terms and Conditions is found to be illegal, invalid, or unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

18.1. Entire Agreement Clause
These Terms and Conditions, together with the Privacy Policy and any other legal notices or agreements published by Tyra Motorworks on the website, constitute the entire agreement between you and Tyra Motorworks with respect to ClubTyra membership. Any prior or contemporaneous agreements, whether written or oral, are superseded.

19. Right to Assign

19.1. Assignment of Rights
Tyra Motorworks reserves the right to assign, transfer, or sublicense its rights and obligations under these Terms and Conditions to any third party at any time with a prior notice to the ClubTyra Member.
